1. Acceptance of Terms

By accessing or using DocClarity AI (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

DocClarity AI is an AI-powered document analysis tool that provides summaries, risk analysis, key party identification, and other insights from uploaded documents. The Service is provided by Orchestrix AI LLC.

3. Beta Service Notice

DocClarity AI is currently in beta. During the beta period:

• The Service is provided free of charge
• Credits are provided at no cost for testing purposes
• Features may change without notice
• Service availability is not guaranteed
• You will be notified before paid plans are introduced

4. Acceptable Use

You may use DocClarity AI only for lawful purposes. You must not:

1. Upload documents you do not have the right to share
2. Upload documents containing others' personal data without their consent
3. Use the Service for any illegal purpose
4. Attempt to reverse engineer or circumvent security
5. Upload malicious files or attempt to harm the Service
6. Use the Service to process classified or government-restricted documents
7. Resell or commercialise the Service without permission

5. Document Content and Privacy

5.1 Your documents remain yours. You retain all rights to documents you upload.

5.2 By uploading a document, you confirm you have the legal right to share its contents for analysis.

5.3 Document content is processed by Google's Gemini AI (primary provider) and Anthropic's Claude AI (fallback provider) models. By using the Service, you consent to this processing.

5.4 We do not read, sell, or share your document content except as described in our Privacy Policy.

5.5 You are responsible for ensuring you comply with any confidentiality obligations before uploading.

6. AI-Generated Content Disclaimer

IMPORTANT: AI analysis results are for informational purposes only.

DocClarity AI results:

• Are generated by artificial intelligence
• May contain errors, omissions, or inaccuracies
• Do not constitute legal, financial, medical, immigration, or professional advice
• Should not be relied upon as a substitute for professional advice
• May not reflect the most current laws or regulations

Always verify important findings with the original document and a qualified professional before making decisions.

7. Credits and Payment

7.1 Beta credits are provided free of charge and have no monetary value.

7.2 Paid credit plans will be introduced after the beta period. You will be notified at least 14 days before any charges apply.

7.3 Credits are non-transferable and linked to your device session.

7.4 Unused credits may expire. Expiry terms will be communicated when paid plans launch.

8. Intellectual Property

8.1 The DocClarity AI software, design, and branding are owned by Orchestrix AI LLC. All rights reserved.

8.2 “DocClarity AI” and “Orchestrix AI” are trading names of Orchestrix AI LLC.

8.3 AI-generated analysis results produced from your documents are provided to you for your use.

9. Limitation of Liability

To the maximum extent permitted by Malaysian law:

9.1 DocClarity AI is provided “as is” without warranties of any kind.

9.2 Orchestrix AI LLC is not liable for:

• Errors in AI-generated analysis
• Decisions made based on analysis results
• Loss of data due to technical failures
• Service interruptions or downtime
• Indirect, incidental, or consequential damages

9.3 Our total liability to you shall not exceed the amount you paid for the Service in the preceding 12 months.

10. Indemnification

You agree to indemnify Orchestrix AI LLC against any claims arising from:

• Your use of the Service
• Your violation of these Terms
• Documents you upload that infringe third party rights

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Wyoming, United States of America, without regard to conflict of law principles.

Orchestrix AI LLC is a limited liability company registered in Wyoming, USA.

For users in Malaysia: Your rights under the Personal Data Protection Act 2010 (PDPA) are not affected by these Terms.

For users in the European Union: Your rights under GDPR are not affected by these Terms.

For users in other jurisdictions: Nothing in these Terms is intended to limit your rights under applicable mandatory local laws.

Disputes shall be resolved in the courts of Wyoming, USA, except where local mandatory law requires otherwise.

12. Changes to Terms

We may update these Terms at any time. Significant changes will be notified in the application at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance.
